FUNDAMENTAL PROVISIONS AND NATURE OF THE PLATFORM<\/h2>\n<p data-start=\"748\" data-end=\"858\">1.1. The web platform <strong data-start=\"771\" data-end=\"790\"><a class=\"decorated-link\" href=\"http:\/\/www.insajder.si\" target=\"_new\" rel=\"noopener\" data-start=\"773\" data-end=\"788\">www.insajder.si<\/a><\/strong> (hereinafter: <em data-start=\"808\" data-end=\"816\">Portal<\/em>) is a private, closed, and non-public platform.<\/p>\n<p data-start=\"860\" data-end=\"940\">1.2. The operator of the Portal is <strong data-start=\"888\" data-end=\"910\">Jernej Lukman s.p.<\/strong> (hereinafter: <em data-start=\"928\" data-end=\"938\">Provider<\/em>).<\/p>\n<p data-start=\"942\" data-end=\"1070\">1.3. The Portal <strong data-start=\"954\" data-end=\"975\">is not a public service<\/strong>, is not intended for the general public, and does not operate on a subscription, membership, or access sales model.<\/p>\n<p data-start=\"1072\" data-end=\"1277\">1.4. The Portal represents an <strong data-start=\"1096\" data-end=\"1175\">internal, non-binding, supplementary communication and information environment<\/strong> that may exist solely as an addition to a contractual or potential business relationship with the Provider.<\/p>\n<hr data-start=\"1279\" data-end=\"1282\">\n<h2 data-start=\"1284\" data-end=\"1319\">2. REGISTRATION EXCLUSIVELY WITH CODE<\/h2>\n<p data-start=\"1321\" data-end=\"1408\">2.1. Registration on the Portal is possible <strong data-start=\"1359\" data-end=\"1407\">exclusively with an individual registration code<\/strong>.<\/p>\n<p data-start=\"1410\" data-end=\"1462\">2.2. The registration code is granted to the user by the Provider:<\/p>\n<ul data-start=\"1463\" data-end=\"1648\">\n<li data-start=\"1463\" data-end=\"1501\">\n<p data-start=\"1465\" data-end=\"1501\">following a prior individual consultation,<\/p>\n<\/li>\n<li data-start=\"1502\" data-end=\"1548\">\n<p data-start=\"1504\" data-end=\"1548\">upon conclusion of a business consulting agreement,<\/p>\n<\/li>\n<li data-start=\"1549\" data-end=\"1648\">\n<p data-start=\"1551\" data-end=\"1648\">or exceptionally to persons whom the Provider determines may potentially become clients in the future.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1650\" data-end=\"1675\">2.3. The registration code:<\/p>\n<ul data-start=\"1676\" data-end=\"1815\">\n<li data-start=\"1676\" data-end=\"1701\">\n<p data-start=\"1678\" data-end=\"1701\">does not represent a right,<\/p>\n<\/li>\n<li data-start=\"1702\" data-end=\"1719\">\n<p data-start=\"1704\" data-end=\"1719\">is not transferable,<\/p>\n<\/li>\n<li data-start=\"1720\" data-end=\"1775\">\n<p data-start=\"1722\" data-end=\"1775\">may be limited in time, content, or functionality,<\/p>\n<\/li>\n<li data-start=\"1776\" data-end=\"1815\">\n<p data-start=\"1778\" data-end=\"1815\">may be revoked by the Provider at any time.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1817\" data-end=\"1926\">2.4. The Provider may refuse or disable registration <strong data-start=\"1871\" data-end=\"1925\">without explanation and without any liability<\/strong>.<\/p>\n<hr data-start=\"1928\" data-end=\"1931\">\n<h2 data-start=\"1933\" data-end=\"1983\">3. COMPLIMENTARY ACCESS \u2013 NO SERVICE RELATIONSHIP<\/h2>\n<p data-start=\"1985\" data-end=\"2076\">3.1. Access to the Portal, content, Discord community, and video content is <strong data-start=\"2053\" data-end=\"2075\">exclusively complimentary<\/strong>.<\/p>\n<p data-start=\"2078\" data-end=\"2093\">3.2. For access:<\/p>\n<ul data-start=\"2094\" data-end=\"2273\">\n<li data-start=\"2094\" data-end=\"2119\">\n<p data-start=\"2096\" data-end=\"2119\"><strong data-start=\"2096\" data-end=\"2116\">no invoice is issued<\/strong>,<\/p>\n<\/li>\n<li data-start=\"2120\" data-end=\"2152\">\n<p data-start=\"2122\" data-end=\"2152\"><strong data-start=\"2122\" data-end=\"2149\">no service is charged<\/strong>,<\/p>\n<\/li>\n<li data-start=\"2153\" data-end=\"2208\">\n<p data-start=\"2155\" data-end=\"2208\"><strong data-start=\"2155\" data-end=\"2205\">no subscription or consumer relationship is created<\/strong>,<\/p>\n<\/li>\n<li data-start=\"2209\" data-end=\"2273\">\n<p data-start=\"2211\" data-end=\"2273\"><strong data-start=\"2211\" data-end=\"2272\">no permanent or recurring obligation of the Provider arises<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2462\" data-end=\"2604\">3.3. The Portal and its content <strong data-start=\"2493\" data-end=\"2517\">are not subject to a contract<\/strong>, but merely a supplementary, non-binding option that the Provider may withdraw at any time.<\/p>\n<hr data-start=\"2606\" data-end=\"2609\">\n<h2 data-start=\"2611\" data-end=\"2651\">4. SCOPE OF CONTENT (INFORMATIONAL NATURE)<\/h2>\n<p data-start=\"2653\" data-end=\"2698\">4.1. Users may be granted access to:<\/p>\n<ul data-start=\"2699\" data-end=\"2901\">\n<li data-start=\"2699\" data-end=\"2724\">\n<p data-start=\"2701\" data-end=\"2724\">conceptual portfolios,<\/p>\n<\/li>\n<li data-start=\"2725\" data-end=\"2775\">\n<p data-start=\"2727\" data-end=\"2775\">analytical, illustrative, or theoretical examples,<\/p>\n<\/li>\n<li data-start=\"2776\" data-end=\"2874\">\n<p data-start=\"2778\" data-end=\"2874\">video content in which <strong data-start=\"2802\" data-end=\"2873\">team members comment on general market developments<\/strong>,<\/p>\n<\/li>\n<li data-start=\"2875\" data-end=\"2901\">\n<p data-start=\"2877\" data-end=\"2901\">a closed Discord community.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2903\" data-end=\"2923\">4.2. All content is:<\/p>\n<ul data-start=\"2924\" data-end=\"2995\">\n<li data-start=\"2924\" data-end=\"2934\">\n<p data-start=\"2926\" data-end=\"2934\">general,<\/p>\n<\/li>\n<li data-start=\"2935\" data-end=\"2946\">\n<p data-start=\"2937\" data-end=\"2946\">impersonal,<\/p>\n<\/li>\n<li data-start=\"2947\" data-end=\"2963\">\n<p data-start=\"2949\" data-end=\"2963\">educational,<\/p>\n<\/li>\n<li data-start=\"2964\" data-end=\"2979\">\n<p data-start=\"2966\" data-end=\"2979\">informational,<\/p>\n<\/li>\n<li data-start=\"2980\" data-end=\"2995\">\n<p data-start=\"2982\" data-end=\"2995\">conceptual.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2997\" data-end=\"3111\">4.3. The content <strong data-start=\"3010\" data-end=\"3051\">is not tailored to individual users<\/strong>, their profile, objectives, knowledge, or financial situation.<\/p>\n<hr data-start=\"3113\" data-end=\"3116\">\n<h2 data-start=\"3118\" data-end=\"3164\">5. EXPRESS EXCLUSION OF REGULATED SERVICES<\/h2>\n<p data-start=\"3166\" data-end=\"3218\">5.1. The Portal and its content <strong data-start=\"3197\" data-end=\"3217\">do not constitute<\/strong>:<\/p>\n<ul data-start=\"3219\" data-end=\"3438\">\n<li data-start=\"3219\" data-end=\"3248\">\n<p data-start=\"3221\" data-end=\"3248\">investment advice,<\/p>\n<\/li>\n<li data-start=\"3249\" data-end=\"3288\">\n<p data-start=\"3251\" data-end=\"3288\">personal investment recommendations,<\/p>\n<\/li>\n<li data-start=\"3289\" data-end=\"3314\">\n<p data-start=\"3291\" data-end=\"3314\">asset management,<\/p>\n<\/li>\n<li data-start=\"3315\" data-end=\"3345\">\n<p data-start=\"3317\" data-end=\"3345\">brokerage services,<\/p>\n<\/li>\n<li data-start=\"3346\" data-end=\"3438\">\n<p data-start=\"3348\" data-end=\"3438\">marketing of financial instruments,<br>within the meaning of ZTFI-1, MiFID II, or any other regulation.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3440\" data-end=\"3485\">5.2. No information, statement, or comment:<\/p>\n<ul data-start=\"3486\" data-end=\"3595\">\n<li data-start=\"3486\" data-end=\"3524\">\n<p data-start=\"3488\" data-end=\"3524\">constitutes a call to transaction,<\/p>\n<\/li>\n<li data-start=\"3525\" data-end=\"3561\">\n<p data-start=\"3527\" data-end=\"3561\">creates a binding relationship,<\/p>\n<\/li>\n<li data-start=\"3562\" data-end=\"3595\">\n<p data-start=\"3564\" data-end=\"3595\">creates expectations of return.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"3597\" data-end=\"3600\">\n<h2 data-start=\"3602\" data-end=\"3650\">6. COMPLETE TRANSFERABLE AND DISCRETIONARY RIGHT<\/h2>\n<p data-start=\"3652\" data-end=\"3731\">6.1. The Provider reserves the <strong data-start=\"3679\" data-end=\"3726\">absolute and unlimited discretionary right<\/strong> to:<\/p>\n<ul data-start=\"3732\" data-end=\"3849\">\n<li data-start=\"3732\" data-end=\"3747\">\n<p data-start=\"3734\" data-end=\"3747\">restrict access,<\/p>\n<\/li>\n<li data-start=\"3748\" data-end=\"3782\">\n<p data-start=\"3750\" data-end=\"3782\">temporarily or permanently revoke access,<\/p>\n<\/li>\n<li data-start=\"3783\" data-end=\"3811\">\n<p data-start=\"3785\" data-end=\"3811\">delete a user account,<\/p>\n<\/li>\n<li data-start=\"3812\" data-end=\"3849\">\n<p data-start=\"3814\" data-end=\"3849\">disable Discord or video access,<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3851\" data-end=\"3915\">and to do so <strong data-start=\"3857\" data-end=\"3870\">at any time<\/strong>, without explanation and without legal consequences.<\/p>\n<p data-start=\"3917\" data-end=\"4013\">6.2. The user expressly waives any claims, compensation, or rights arising from:<\/p>\n<ul data-start=\"4014\" data-end=\"4075\">\n<li data-start=\"4014\" data-end=\"4031\">\n<p data-start=\"4016\" data-end=\"4031\">loss of access,<\/p>\n<\/li>\n<li data-start=\"4032\" data-end=\"4048\">\n<p data-start=\"4034\" data-end=\"4048\">loss of content,<\/p>\n<\/li>\n<li data-start=\"4049\" data-end=\"4075\">\n<p data-start=\"4051\" data-end=\"4075\">interruption of communication.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"4077\" data-end=\"4080\">\n<h2 data-start=\"4082\" data-end=\"4138\">7. USER RESPONSIBILITY AND EXCLUSION OF LIABILITY<\/h2>\n<p data-start=\"4140\" data-end=\"4210\">7.1. The user acknowledges that all decisions are made <strong data-start=\"4192\" data-end=\"4209\">exclusively by themselves<\/strong>.<\/p>\n<p data-start=\"4212\" data-end=\"4279\">7.2. The Provider, Jernej Lukman, or team members <strong data-start=\"4257\" data-end=\"4275\">are not liable<\/strong> for:<\/p>\n<ul data-start=\"4280\" data-end=\"4385\">\n<li data-start=\"4280\" data-end=\"4298\">\n<p data-start=\"4282\" data-end=\"4298\">financial losses,<\/p>\n<\/li>\n<li data-start=\"4299\" data-end=\"4319\">\n<p data-start=\"4301\" data-end=\"4319\">lost profits,<\/p>\n<\/li>\n<li data-start=\"4320\" data-end=\"4352\">\n<p data-start=\"4322\" data-end=\"4352\">indirect or direct damages,<\/p>\n<\/li>\n<li data-start=\"4353\" data-end=\"4385\">\n<p data-start=\"4355\" data-end=\"4385\">misinterpretation of content.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"4387\" data-end=\"4462\">7.3. Past examples or comments <strong data-start=\"4424\" data-end=\"4461\">do not guarantee future results<\/strong>.<\/p>\n<hr data-start=\"4464\" data-end=\"4467\">\n<h2 data-start=\"4469\" data-end=\"4503\">8. COPYRIGHT AND CONFIDENTIALITY<\/h2>\n<p data-start=\"4505\" data-end=\"4544\">8.1. All content is protected by copyright.<\/p>\n<p data-start=\"4546\" data-end=\"4566\">8.2. The following is prohibited:<\/p>\n<ul data-start=\"4567\" data-end=\"4654\">\n<li data-start=\"4567\" data-end=\"4578\">\n<p data-start=\"4569\" data-end=\"4578\">recording,<\/p>\n<\/li>\n<li data-start=\"4579\" data-end=\"4591\">\n<p data-start=\"4581\" data-end=\"4591\">copying,<\/p>\n<\/li>\n<li data-start=\"4592\" data-end=\"4603\">\n<p data-start=\"4594\" data-end=\"4603\">sharing,<\/p>\n<\/li>\n<li data-start=\"4604\" data-end=\"4654\">\n<p data-start=\"4606\" data-end=\"4654\">disclosure to third parties,<br>in whole or in part.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"4656\" data-end=\"4747\">8.3. Violation may result in immediate termination of access and enforcement of legal remedies.<\/p>\n<hr data-start=\"4749\" data-end=\"4752\">\n<h2 data-start=\"4754\" data-end=\"4784\">9. PERSONAL DATA PROTECTION<\/h2>\n<p data-start=\"4786\" data-end=\"4858\">9.1. Personal data is processed exclusively for the purpose of enabling access.<\/p>\n<p data-start=\"4860\" data-end=\"4950\">9.2. Data may be stored or deleted at the Provider&#8217;s discretion, in accordance with applicable law.<\/p>\n<hr data-start=\"4952\" data-end=\"4955\">\n<h2 data-start=\"4957\" data-end=\"4978\">10. FINAL PROVISIONS<\/h2>\n<p data-start=\"4980\" data-end=\"5025\">10.1. The law of the Republic of Slovenia applies.<\/p>\n<p data-start=\"5027\" data-end=\"5066\">10.2. The competent court is in Slovenia.<\/p>\n<p data-start=\"5068\" data-end=\"5138\">10.3.
